Will John Wiley Price be charged with assault?
It looks as if a Dallas County grand jury will decide whether commissioner John Wiley Price will be charged with Assault. A special prosecutor has been assigned to investigate the scuffle between commissioner Price and former City Council member Dwaine Caraway. Caraway’s staffer accused Price of choking him during the altercation. The special prosecutor will decide whether the case is actually presented to the grand jury. The special prosecutor is necessary because the Dallas DA’s office works with Price regularly. This is another instance where the Dallas Police Department is referring the matter to a grand jury rather than deciding if they have probable cause to arrest Price.
I do not feel the grand jury will charge Price with assault. Most of the altercation was recorded and there were several witnesses to the incident. If there was enough evidence indicating Price assaulted the staffer, the Dallas Police would have already arrested him. Since this offense is a class A misdemeanor, it only takes an officer having probable cause to make an arrest. Probable cause is one of the lowest burdens in our legal system. Presenting the case to the grand jury is not necessary. But, this certainly indicates to me the evidence against Price is weak.
