Statutory Rape occurs when a person has consensual sex with someone under the age of consent. The age of consent in Texas is 17 years of age.    There is an exception that allows a person to have sex with someone under 17 as long as the older person is not more than three years older than the minor.  This exception does not apply to registered sex offenders or to couples of the same sex.

Statutory Rape in Texas is a Second Degree Felony, with a punishment range of 2 to 20 years in prison.  If the minor is under 14 years old, the offense is considered aggravated sexual assault and it is a First Degree Felony, with a punishment range of 5 years to life in prison.
